These Terms of Service ("Terms") govern your access to and use of thermalcove.com (the "Site") and any purchase you make from Thermal Cove ("Thermal Cove," "we," "us," or "our"). Thermal Cove is a sole proprietorship operating in Ontario, Canada. By accessing the Site or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
1. Eligibility & Accounts
You must be at least the age of majority in your province of residence to place an order. If you create an account, you're responsible for keeping your login credentials confidential and for all activity under your account. Accounts are personal to you and may not be transferred.
2. Products
We sell curated wellness equipment, including saunas and cold plunge tubs, sourced from third-party manufacturers and brand partners ("Manufacturer Partners"). We make reasonable efforts to display accurate product descriptions, dimensions, specifications, and images, but colors, finishes, and appearance may vary slightly from what you see on your screen due to display settings, and specifications are subject to change by the Manufacturer Partner without notice.
Certain products are subject to additional terms set by the Manufacturer Partner (such as warranty coverage, minimum advertised pricing, or return eligibility). Where applicable, those terms are noted on the relevant product page and form part of your purchase agreement with us for that item.
3. Health & Safety
Our products, including saunas and cold plunge tubs, are wellness equipment intended for general relaxation and recreational use. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Any statements about potential wellness benefits on the Site are general in nature and not a substitute for professional medical advice.
Before using any product purchased from us, read and follow all safety and usage instructions included with it. If you are pregnant, have a heart condition, high or low blood pressure, or any other medical condition, or are otherwise unsure whether use of a sauna, cold plunge, or similar product is appropriate for you, consult a physician before use. Use of our products is at your own risk, and you are responsible for using them safely, as directed, and in accordance with the manufacturer's instructions.
4. Orders & Order Acceptance
Placing an order is an offer to purchase, which we may accept or decline at our discretion — for example, if a product is unavailable, mispriced, or if we suspect fraud. We'll notify you if we're unable to fulfill your order and refund any payment already collected.
Order cancellations are handled under our [Refund Policy](/policies/refund-policy). Because many of our products are ordered from Manufacturer Partners on a per-order basis, our ability to accommodate a cancellation is time-sensitive and may be limited once fulfillment has begun.
Products purchased through the Site are for personal, household use only and not for commercial resale, unless we've agreed to a wholesale or dealer arrangement with you in writing.
5. Pricing & Payment
All prices are listed in Canadian dollars (CAD) and exclude applicable taxes and shipping unless stated otherwise. Prices reflect the rate at the time your order is placed and are subject to change without notice for future orders. Applicable GST/HST/PST (based on your shipping destination within Canada) will be added at checkout.
You agree to provide current, complete, and accurate payment information and authorize us (or our payment processor) to charge your chosen payment method for the full order total, including taxes and shipping. Product will not be released for delivery until payment has been received in full.
Some products may carry a minimum advertised price set by the Manufacturer Partner; where this applies, we're not able to advertise or sell that product below the specified floor without the Manufacturer Partner's approval.
6. Shipping & Delivery
Shipping is governed by our [Shipping & Delivery Policy](/policies/shipping-policy), which forms part of these Terms. Delivery timeframes are estimates only; we are not liable for delays caused by carriers, weather, or circumstances outside our reasonable control, though we will make reasonable efforts to keep you informed of any known delays.
7. Returns, Refunds & Warranty
Returns and refunds are governed by our [Refund Policy](/policies/refund-policy). Product warranties are provided by the Manufacturer Partner for that product and are described on the relevant product page and/or provided with your order; warranty service is typically coordinated through the Manufacturer Partner's own service process, and we'll assist you in initiating a claim.
8. Intellectual Property
All content on the Site — including text, graphics, logos, product photography, and design — is owned by Thermal Cove or our licensors and is protected by Canadian and international intellectual property law. You may view and download content for personal, non-commercial use only. Any other use, including reproduction or redistribution, requires our prior written consent. Manufacturer Partner trademarks and logos displayed on the Site remain the property of their respective owners and are used with permission or under license.
9. Third-Party Services
The Site may use third-party tools and services (for example, our e-commerce platform provider, payment processor, and delivery carriers) to operate. These tools are provided by their respective operators and are subject to their own terms; we don't control and aren't responsible for their availability or performance, though we choose our service providers carefully and require them to handle your information consistently with our Privacy Policy.

11. Prohibited Use
You agree not to use the Site to: violate any applicable law; infringe our or a third party's intellectual property rights; transmit malware, spam, or unsolicited communications; attempt to gain unauthorized access to the Site or its systems; or impersonate any person or entity. Automated access to the Site (including by bots or AI agents) must identify itself as such and may not attempt to circumvent security measures such as CAPTCHAs.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Thermal Cove is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of a product, even if advised of the possibility of such damages. Nothing in these Terms is intended to exclude or limit any warranty, condition, or right that cannot lawfully be excluded or limited under Ontario or federal Canadian consumer protection law, including the *Consumer Protection Act, 2002* (Ontario) — where such a right applies, these Terms apply only to the extent permitted by law.
13. Indemnification
You agree to indemnify and hold Thermal Cove harmless from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or misuse of the Site.
14. Termination
We may suspend or terminate your access to the Site at our discretion, including for suspected violation of these Terms. You remain responsible for any amounts owed to us at the time of termination.
15. Changes to These Terms
We may update these Terms from time to time; the "Last updated" date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
